全国調査業協同組合連合会 教育研修会
今週火曜日（１０月１６日）、東京で全国調査業協同組合の教育研修会が開催された。組合の副理事長と云う立場上、遠路大阪からではあるが参加しない訳にも行かず、受講して来た。
カリキュラムは例年通りで、主務官庁の警察や消費者センターなど行政からのお話しと、探偵業法の立案者、前衆議院議員の葉梨康弘先生及び弁護士先生の話が主なものであったが、今回の研修会は結構中身の濃い充実したものであった様に思う。
どうしてそんな事に成ったのかと首を傾げるが、探偵業にクーリングオフが適用される事に成ったこと。
所謂、契約を交わして後、８日間内であればキャンセルが可能になった事である。ただ、全ての契約がそうでは無く、営業所及び依頼者宅以外での契約、所謂、喫茶店やレストラン、ホテルなどで個人の人と契約した場合にクーリングオフが適用となる。
それにしても、この探偵業の契約は、夫婦間の問題など、依頼者宅では話しし辛い事も多く、喫茶店やレストランなどでと言うケースも往々にある。
ところが、この場合、依頼者は、仕事に直ぐかかって欲しい、明日、明後日を逃したら、また何時になるか判らない等・・・急を要する調査依頼は多くあるが、クーリングオフが適用になると、費用を掛けて調査し、結果報告をした後に、依頼者がキャンセルを言ってくると、全てパー、お金は１００％返却しなければならないと言う、極めて理不尽な事が起きる事になる。
そんなバカな・・・と思うが、クーリングオフが適用になれば、契約後８日以内であれば、理由のいかんを問わず基本的に解約は可能になってしまいます。
クーリングオフは本来、訪問販売や電話勧誘など一方的に営業を掛け、言葉巧みにその場の雰囲気で契約に持ち込むなどの営業に、クーリングオフ期間を設け、消費者が冷静に考えれる時間をつくったもので、限られた業種を対称としていた。ところが１年ほど前の法改正で、大半の業種がクーリングオフが適用される事となり、自然、調査業も含まれる事になったようである。
This Tuesday (October 16), an education and training session for national research cooperatives was held in Tokyo. As a vice-chairman of the union, I came all the way from Osaka, but I couldn’t afford not to attend the meeting.
The curriculum was the same as usual, and it was mainly a talk from the administration such as the police and the consumer center of the competent government agency, and a talk by the planner of the detective business law, Mr. Yasuhiro Harashi, a former member of the House of Representatives, and a lawyer.
You may be wondering how it happened, but it turned out that a cooling-off was applied to the detective business.
So to speak, it is possible to cancel within 8 days after signing the contract. However, this is not the case for all contracts, and the cooling-off is applied when the contract is made with an individual in a place other than a business office or client’s home, such as a coffee shop, restaurant or hotel.
By the way, there are many things that are difficult to talk about in the client’s home, such as marital problems, and there are often cases where the contract is made at a coffee shop or restaurant.
However, in this case, the client wants the work to be done immediately, and if he misses tomorrow or the day after tomorrow, he doesn’t know what time it will be again… There are many requests for investigation that require urgency.
I think that’s ridiculous, but if cooling-off is applied, you can basically cancel the contract within 8 days of the contract, regardless of the reason.
Originally, the cooling-off period was set up to give consumers time to think calmly about the situation, and it was used for a limited number of industries. However, due to the amendment of the law about a year ago, most of the industries are now able to apply the cooling-off, which naturally includes the research industry.
