探偵業法セミナー
先週２３日、勤労感謝の日にも関わらず東京で開かれた「探偵業新法の特別セミナー」に参加してきた。先週のブログに記載した通り、
このセミナーは「探偵業新法」成立の立役者である衆議院議員葉梨康弘先生が、業法の解説書「探偵業法」（立法までの物語と逐条解説、
立花書房）の出版を記念し開催されしたもので、４時間半の長時間に亙るものであった。
開催に際し事前に業界団体への参加要請もあり、参加状況が気がかりであったが開演１０分前には会場はほぼ満杯、
多分４００名を超えていたのでは・・と思われる盛況であった。それだけ業界人にとって大きな関心事であったと言うことでしょう。
講演内容は、法案の作成に直接携わった（議員立法）先生の話だけに、
非常に判りやすくしかも要点をキッチリと捉えた内容の濃いものであり、４時間半の講演が正直アッという間の短さに感じられるものであった。
但し、法律そのものは、消費者保護（依頼者保護）と被調査人の保護を目的としたもので、業の育成は全く眼中に無く、
業界にとっては相当厳しい内容のものとなっている。しかも、この法律は議員立法によるもので、与野党全会一致でなければ可決・成立は難しく、
その為に、内閣委員会の議事録などに目を通すと、法案提出議員が如何に妥協に妥協を重ね、
全会一致での成立に努力し我慢をしたのかが読み取れるものである。
仄聞するところによると民主党は、人権の視点不足を指摘し、当初この法案には難色を示していたやに聞くが、イザ蓋を開けてみると、
法案提出者に民主党議員が名を連ね、委員会では、
野党であるはずの民主党議員の質問に民主党議員が答えるという前代未聞の審議をごく短時間の間に行い、
人権や表現の自由など憲法問題に関わるような極めて大切な問題を完全な出来レースで片付けている。正直、アッと驚くような応答を、
何処まで判っているのか疑問に思える民主党の若手議員が行っている。「こんなやりかたで国の法律ともあろうものがつくられていいのか・・！」
と叫びたくなるようなやり方である。
結果、業界には規制と義務のみを課し、育成の視点は微塵もなく、依頼者と被調査人の保護のみをうたい、業者は公安委員会（警察）
の監視下の基で、個人情報保護に最大の配慮をしながら、
あらゆる法律に抵触しない公明正大な調査方法で依頼者の求める情報を入手し報告しなさい、そうでなければ法で罰しますよ、という事である。
所謂、探偵社取締り法である。

In this seminar, Professor Yasuhiro Harashi, a member of the House of Representatives, one of the architects of the enactment of the “New Detective Business Law”, will present a book on the business law, “Detective Business Law” (story and article-by-article commentary up to the enactment of the law).
The event was held in commemoration of the publication of the book (Tachibana Shobo) and lasted for four and a half hours.
There was a request for participation from industry groups prior to the event, so we were concerned about the level of participation, but the hall was almost full 10 minutes before the opening.
There were probably more than 400 people there… It was a great success. This is why it was a major concern for people in the industry.
The lecture was given by a teacher who was directly involved in drafting the bill (legislator).
It was very easy to understand, and the content was so dense that it caught the point exactly. To be honest, the four-and-a-half-hour lecture seemed to be very short.
The law itself, however, is intended to protect consumers (protection of clients) and respondents, and does not focus on the development of the business at all.
It’s a pretty tough one for the industry. In addition, this law is legislated by the members of the Diet, and it is difficult to pass and enact it unless it is unanimously approved by the ruling and opposition parties.
In order to do so, if you look at the minutes of the cabinet committee meetings, you’ll see how many compromises were made by the lawmakers, and how much they were willing to compromise.
It is easy to see how they made an effort and put up with it in order to pass it unanimously.
It is said that the Democratic Party of Japan was initially reluctant to oppose this bill, pointing out the lack of a human rights perspective.
Democratic lawmakers were named among the bill’s filers in the committee.
In a very short period of time, an unprecedented deliberation, in which a Democratic member of the House of Representatives answered a question from a Democratic member of the House of Representatives who was supposed to be the opposition party.
It is a complete shameless dismissal of extremely important issues such as human rights and freedom of expression as they relate to constitutional issues. To be honest, I’m surprised at the response.
I wonder how far they know…young Democratic lawmakers are going. I don’t believe this is the way the law of the land should be written…
