戸籍法改正（法制審議会戸籍法部会）への意見書、NO２
先週5月２５日、「探偵業の業務の適正化に関する法律案」（探偵業法案）
が衆議院で可決されたとの朗報が入った。運用面では色んな問題が出てくるように思うが法制化は業界人の悲願であっただけに、
先ずは皆で喜びたいと思う。
先々週のブログで戸籍法改正問題についての法制審議会戸籍法部会に提出した意見書的なものの一部を掲載したが、今日はその続き、
「戸籍が原則非公開になると具体的にこんな問題はどうするのだ・・・」と云うことから、最近取り扱った調査事例を列記して送付したので、
それを掲載することにする。
戸籍、住民票での確認を必要とする最近の具体的調査事例
不動産関係
・調査依頼内容
金銭消費貸借に伴い自宅の土地建物に抵当権が設定されている。ところが実際には7年前に借入は返済し貸借関係は終了しているが、
抵当権の抹消手続きを怠っていた。この度、あることで抵当権を抹消する必要に迫られ、抵当権者に連絡をとろうとしたが、
登記簿に記載されている住所から既に転居していた。従って、近隣者に聞きまわったが誰も転居先は知らないとのこと。
そこで、抵当権者の現住所を割り出して欲しい、との依頼。
（調査結果）
抵当権者は既に他界していたが該当不動産の相続権者である妻と子供3人の現住所を割り出すことができた。
結果、依頼者は相続権者に事情を説明し、無事抵当権を抹消することができた。
※、こうした事はごく普通にあるが、戸籍、住民票が原則非公開になると相続権者の住所割り出しは非常に難しくなる。
また、不動産の売買に関し、土地建物の所有者割り出しに関する依頼は多くある。しかも、
所有権者が登記上の住所地を転居しているケースや既に他界しているケースは多々あるが戸籍・
住民票が原則非公開になると不動産取引にも大きな影響が出てくることが懸念される。
・調査依頼内容
取引先の倒産に伴い５千万円が焦げ付いた。取引開始から半年しか経ってなく、前後の状況からして取り込み詐欺の疑いもある。
そこで、代表者の資産背景を調査して欲しいとの依頼。
（調査結果）
非調査人の現住所は大阪の賃貸マンションで見るべき資産は無かったが、山梨の本籍及びその付近に相当な不動産の所有が判明し、
法的に差し押さえることができた。
※ 住民票・戸籍が非公開になると、この手の調査は不可能に近くなると同時に取込詐欺や債権の踏み倒しは、
非公開を機に倍増することが懸念される。
商取引関係
・調査依頼内容
当社とアメリカの某企業との間で、○○の輸入販売に関わる合弁会社をつくる話が進んでおり、
既にその為に資本金2千万円の株式会社を設立したが、その話のエイジェントである人物の素性がよく判らない。
可なりの有力者であると思われる力を実際に見せ付けられており、副社長がプロジェクトリーダーとなり半年前から着々と準備は進め、
2ケ月先には帝国ホテルでパーテイも予定している。しかし、どうにも気になるとの事でメインバンクを介して依頼があった。
（調査結果）
そのエイジェントなる人物は希代の詐欺師と呼ばれた大物詐欺師であることが判明。過去には芸能人、世界的ピアニスト、
大学教授から政治家まで相当の人が騙され、マスコミを賑わしたこともある詐欺師であった。
※ これは、多方面に亙る取材から住民票の登録住所が判明し、住民票を入手できた事から、前住所及び本籍地で過去の犯罪歴が判明し、
根からの詐欺師である事が判ったものである。結果、年商５０億円の企業を救う事が出来たが、戸籍・
住民票が非公開となれば数億の金を騙し取られて倒産の憂目をみたと思われる程の内容であった。
・調査依頼内容
知人の紹介で設立間もない会社から数千万円単位の商談が持ち込まれた。先方の社長曰く、
「自分は○○家の一族で近く相当の遺産が入るので、決して支払いでご迷惑をかけるような事はしないが、会社を始めたばかりで信用がない。
売り先も確実な目途があるから、何とか商品を納入して欲しい・・」とのこと。
間違いない人のように思うが本当に○○家の一族なのか調べて欲しい、との依頼。
（調査結果）
○○家の一族に同姓同名の人はいるが、その人はサラリーマンで商売などはしていない。但し、地元を離れて長く、
親族でも詳しくは知らない状況にあることから名前を使われることになったようである。
装い詐欺であったが、事前調査で未然に被害を防止することができた。
・調査依頼内容
母親が娘の事を心配しての相談。
娘は○○師で現在独立を考えている。ところが娘に独立開業を進めている自称、○○の経営コンサルタントという人がどうもおかしいので、
娘に何度も注意し説得しているが娘は信じ込んでおり、私が何を言ってもダメ。
実は、このコンサルタントにあることから娘に内緒で数百万円貸したが、返済の意思を示すだけで実際は約束の十分の一も返してくれない・・・。
（調査結果）
娘を客観的に説得できる内容の調査結果がでた為、調査結果に基づき母親と一緒に娘を説得し、未然に詐欺的被害を防止することができた。
取材による結果もあるが、娘が騙されていると確信するに至ったのは、住民票や戸籍事項からハッキリと証明できる虚偽が数々あったため。
※ 商取引に関しては、住民票及び戸籍の入手により詐欺被害を未然に防止できた調査事例は枚挙に暇が無いくらいある。
婚姻関係
・調査依頼内容
息子が結婚を前提に付き合っている女性が居るが、気の小さい息子は相手の言いなりの様で、借金までして相手に貢いでいる。
息子の話によると「お互いに結婚の意志は確認しあっている」とのこと。ところが、息子に彼女を一度連れてくるように言っているが、
彼女は何かと理由をつけて会おうとしない様子・・。住所も○○町としか知らず番地までは判らない。
「親の感ですが、何となく息子が騙されているような気がしてならないので、事前に彼女のことが知りたい、」との依頼。
（調査結果）
尾行調査で居所をつきとめ、住民票を確認することにより、彼女は既婚者で子供も2人居ることが判明した。詳細は省略するが、
過去にも同様の手口で男に金を貢がせていた人で、結婚詐欺師に近い女性であることが判明した。
・調査依頼内容
娘が結婚を前提に付き合っている男性がいるが、娘より10歳も年上でしかも経歴がハッキリしない。娘は、
「優しく良い人で決して嘘をいうような人ではない」とすっかり信用しているが、親の目から見るとどうも心配な点があるので調べて欲しい、
との依頼。
（調査結果）
男性は住民票を置いている住所地には実際には住んでいなく、別の所で女性と同棲生活（男がころがりこんだ形）をしている事が判明。尚、
戸籍によると被調査人は離婚歴が2回あり、子供も4人居ることが判明。何れも子供は別れた妻が引き取っているが、
男性には養育費の支払い義務があり、現状からすると結婚などとても考えられるような状況になく、
依頼者の娘は完全に騙されていることが判明した。
※ こうした調査依頼及び同様の調査結果はごく普通にあり、決して珍しいケースではない。
・調査依頼内容
事業を子供に譲った父親（70歳）が、介護関係の仕事をしている40代の女性に3千万円以上もつぎ込んでいて再婚したいと言い出した。
ところが不審に思えることが多々あるので、事前に調べて欲しいとの依頼。
（調査結果）
彼女は独身を装い安アパートを借りていたが、実際は別に戸建て住宅を持ち、そこに夫と子供2人が居ることが判明した。尚、
夫は無職で外車を乗り回し、毎日パチンコ三昧の生活をしていることが判明。
※ 結果が出た為それ以上の調査はしなかったが、この女性は過去にも同様の手口で老人に金を貢がせていたものと容易に推察される。
このケースは彼女を雇用している会社にも使用者責任が生じると思われるが、住民票や戸籍の入手なくしては容易に見抜けないものと思われる。
夫婦関係
・調査依頼内容
夫が妻の素行調査を依頼。
原因は、突然妻が離婚して欲しいと言い出した。理由を聞くと、あれが悪いこれが嫌と並べたてるがどうも腑に落ちない。
男が居るのではと問い詰めても「決してそんな事はない」の一点張りとのこと。
（調査結果）
尾行調査により男がいることが判明。相手の男性を調べた結果、名古屋在住で妻と3人の子供が居る男であることが判明した。
後々で判った事であるが、「妻と男性はインターネットで知り合い、メル友が嵩じて男女関係にまで発展したが、
男は独身を装い遊び感覚で付き合ったものである。ところが妻は離婚さえできれば男と結婚できるものと思い込み
（口では男性も結婚をにおわせていた様子）、離婚を迫ったもの。
相手の男は単身赴任で大阪にきており、独身で通用する生活状況の中にあった。ところが、
男性の住民票と戸籍を調べることにより上記事実が判明したもの。
詳細は省くが戸籍住民票なしでは男性の素性は分からなかったと思料されるケースであった。
※ 同様のケースで、単身赴任の男性が独身を装い23歳の女性に子供までつくらせたケースがあるが、
女の方は子供まで出来たのだから当然結婚できるものと考えていた。ところが子供が出来たことを知った男性は、
中絶を勧めたが聞き入れてもらえない為、突然雲隠れした。
調査の結果、九州にいる事が判明し、住民票及び戸籍の入手により、妻子の居る男性であることが判明した。男性を問い詰め、
子供を認知させることは出来たが、極めて無責任な話である。
男女関係
・調査依頼内容
某男性と半年程前に知り合い恋仲になった。彼は医師免許を持っているというが一寸ひかかるところがある。大学は大阪大学と聞いている。
本当に大阪大学卒で医師免許を持っているかどうか調べて欲しい。
（調査結果）
調査の結果、姓は正しいが名が一字違い、大阪大学卒でもなければ医師免許も持っていないことが判明。
※こうしたケースは戸籍、住民票に基づかないと調査結果が曖昧になることがある。戸籍、住民票で正確に確認することにより、
騙されていることが発覚し、被害が少なくて済んだ。
・調査依頼内容
結婚を前提に付き合っている彼女がいる。彼女の話では現在28歳で結婚歴はなく、勤めている会社は○○株式会社とのこと。
ところが時々オヤと思うことがある。本人が話していることが本当かどうか知りたい。
（調査結果）
被調査人は31歳で過去2回結婚歴あり、勤め先は話の通りであるが会社の職種は違い、非常に不安定な内容の会社であった。
※ 住民票及び戸籍によって上記事実の裏づけが取れたが、そうでない限りこうした人は嘘をつき通すことが多い。
雇用関係
採用調査関係では、個人情報保護法施行に伴う弊害のほうが多いが、
年齢詐称、現住所詐称も時々見受けられる。
職歴詐称は求職者の３０％強を占めるほどに、極普通に行われている。しかし、今年４月の個人情報保護法施行に伴い、
官公庁や企業の多くが求職者の職歴確認に応じなくなっている。また、学校も同様で卒業確認も出来なくなっている。
結果、履歴は幾ら詐称しても簡単には分からなくなっており、履歴書を如何に誤魔化して書くかが採否の大きな分かれ道になっている。
その為、東京大学や京都大学の卒業者数がここ2?３年で倍増するのではないかと危惧される状況にある。
※、「差別につながる怖れがあるから・・」との理由から、人に関するあらゆる調査を規制しようとする動きがあり、
その一環で戸籍・住民票を非公開に、と考えられているようですが、何々につながる怖れということで、本来の目的を度外視した規制は、
恐 怖政治の始まりにつながりかねない。
包丁が殺人に使われたからと言って、包丁の使用を禁止するようなことだけは避けて欲しいものです。
