住民基本台帳の閲覧規制
今朝の新聞報道によると総務省は住民基本台帳の閲覧を規制する方向性を打ち出し、総務庁長官に上申したとある。
いよいよ来たかという感じ。個人的には住基台帳の閲覧規制はある意味理解できる部分はあるが、閲覧規制の背景に何があり、今後、
閲覧規制から交付規制と進み、住民票の公開原則を非公開原則にしようとの流れが見え隠れする事を大いに危惧する。
法解釈は難しく素人の私には理解できないものが多いが、住民基本台帳法の第12条（住民票の写し等の交付）2項には、
何人でも市町村長に対し、住民票及び住民票記載事項証明書の交付を請求することができる。となっているにも関わらず、
実際には殆どの市町村で、他人の住民票の交付請求をしても交付してもらえないのが実情である。理由は、総務省通達や条例で、
交付に関し相当厳しく規制している為である。その結果、多種多様な不祥事が起き、一部犯罪の温床にもなっている。しかし、
民事問題が大半であるためマスコミが取り上げる事も少なく、社会問題化するには至っていないが、日常的に男女関係、債権債務、
商取引などのドロドロとした民事に絡む問題の相談を受ける調査会社は、
住民票が入手できないが為に大変な問題が生じていることを危惧している。
国が住民票や戸籍の公開原則を頑なに守って来た背景が何なのか、公開原則が崩れることによってどんな弊害が出てくるのか、
今一歩踏み込んで考えて欲しい。そして公の場でもっともっと議論を進めて欲しいと思う。
