先週、１４日（１２月１４日）からカンボジアを訪問。目的は、私の友人、高山良二（自衛隊当時の同期）が１０年前から不発弾と地雷処理に一命を賭し、滅私奉公している為、彼の活躍を直接この目で見て、何かお役にたてる事が出来たら、との思いからである。

関空から約６時間、タイのバンコク空港に着き、マイクロバスで約６時間、タイとカンボジアの国境着。国境の橋で高山が満面の笑みで迎えてくれた。

高山と小生と妻、国境越えと云う事で可成り緊張していたが、高山の顔もあって至極スムーズ。ただビザ取得にチップがいるとは驚いた。国境の川（上部がタイ、下部がカンボジア）

ビザを取得すると直ぐに高山の車で不発弾及び地雷処理の現場へ・・・。地雷処理に直接携わる高山の部下５名（現地人で給与は高山が代表を務めるＩＭＣＣＤから工面している）

当日午前中の作業で除去した不発弾と地雷。村人の情報提供により現場に急行し搬出、除去したとのこと。普段はこんなに一挙に出ることは無いらしい。

現場を後に高山の宿舎に向かう道路端の風景。 タサエン地区 （旧ポルポト軍の村、住民の大半がポルポト派で一家から一人はポルポト軍に所属していたと云う） の一般住宅。高床式で柱に板を張り付けただけの家。大半の家庭がこんなものである。

村内の商店。何故か４・５軒に１軒くらい駄菓子屋的商店がある。土間に机や椅子を並べ、適当に有るものを売っている感じ・・・。

タサエン地区に入ると同時に相当なカルチャーショク。原始時代にタイムスリップした感じであるが、村民の笑顔と礼儀正しさに、これってどういう事と言った感じ。

Last week, I visited Cambodia from December 14th (December 14th). My friend Ryoji Takayama (a fellow of the Self-Defense Forces at that time) has been risking his life to dispose of unexploded ordnance and land mines for 10 years.

It took about 6 hours from Kansai Airport to Bangkok Airport in Thailand, and about 6 hours by microbus to the border between Thailand and Cambodia. At the border bridge, Takayama greeted me with a broad smile.

As soon as I got my visa, I drove to the site of unexploded ordnance and mine disposal in the high mountains… Five of Takayama’s subordinates who are directly involved in mine disposal (they are locals and their salaries are paid by the IMCCCD, which Takayama represents)

It is a house on stilts with only planks on the columns. The majority of families are like this.

shops in the village. For some reason, there is about one out of every four or five stores like a small candy store. It’s like putting desks and chairs on the earthen floor and selling what’s available…

As soon as we entered the Tasaen area, we had a considerable culture shock. It is a feeling that we have gone back in time to the primitive era, but the smiling faces and politeness of the villagers, this is what I said.

昨夜、忘年会を名目に久しぶりに友人と一杯やった。その友人、ほぼ小生と同い年。ところが、未だ現役で、昨年は丸一年フィリピンで過ごし、今春からは長崎に単身赴任と、頑張っている。

その彼が、仕事の合間を利用し、久しぶりに関西に帰って来た。そこで、一杯やろうかと云う事になった訳であるが、実は、その友人、１週間程前に車で正面衝突事故を起こしたらしい。話によると、車は２台ともぐちゃぐちゃで廃車を余儀なくされる程の事故とか。ところが不幸中の幸いと云うか、エアーバックとシートベルトのお蔭で、自分は胸が少し痛む程度、相手はフロントガラスで頭を切り１０針程度縫ったらしいが、意外と元気らしく、大変な出来事ではあるが、後遺症は無さそうで、ホッと一安心と云ったところ。

その事故にまつわる話であるが、友人は、事故後すぐに警察に通報すると同時に家族にも連絡。すると、救急車とパトがすぐに駆けつけ、自分も相手{頭から大量の血を流しており、命に別状は・・・と思えるような状態であったらしい）も別々の救急車で搬送されたらしい。

連絡を受けた家族は、心配でたまらない。同時に、相手の命は、ケガの具合は・・・？。当然の事ながら、警察に尋ねた。すると、警察官曰く、「お答え出来ません。個人情報ですから・・・」。事故の相手が、何処の病院に運ばれ、どの様な状況にあるのか、当事者は知りたいに決まっているし、命に別状は？と考えると、居てもたってもいられない。極々当然の感情だと思う。ところが警察官は、「個人情報ですのでお答えできません・・・」の一点張りであったとの事。

頭にきた友人「何が個人情報だ・・・？、そんな馬鹿な事があるか・・！」、そうとう楯突いたらしい。すると、その警察官、「実は私たちもこれはおかしいと思っているんです。でも、私の立場ではどうしようも・・・」。

そういえば、以前亀岡市で、集団登校の小学生に無免許運転の車が突っ込み、何人かの小学生が亡くなった事件があったが、その事故の際、加害者の親が被害者に謝罪したく、警察官に尋ね、それに応えた警察官が、その後個人情報漏えいで懲戒処分を受けた、との報道があったのを思い出した。

懲戒処分をするくらいだから、法律に詳しい偉い人が、検討に検討、議論に議論を重ねた結果と思われるが、庶民感覚では何処かおかしい。現実にマッチしていないというか、何のための情報で、何のために情報を保護するのか・・・。ただただ、事なかれ主義で、法の条文に照らし合わせ、ひかかりがあれば全て蓋をしてしまうと云う姿勢が顕著に表れた形の結果に思えてならない。

今回のケースでも、警察官の立場になれば、「個人情報ですから・・・」と言わざるをえないのはよく判る。情にほだされて、何処どこの病院でケガの程度は・・・と答え、結果、懲戒処分を受けるような事になったらたまらないものネ・・・。しかし、教えて何か不都合があるのであろうか・・・。それとも、相手を心配するのはお前の勝手で、心配なら勝手に心配しておけばいい、と云うのが正しい考え方なのか。

少なくとも小生は、そんな社会には住みたくない。情の通わない、情を察しようともしない様な社会での生活などまっぴら御免である。

私の尊敬する中村天風先生は、「情味を味わって生きるのが、人生のだいご味である」、「人は常に、生きるための情味をみいだそう」とさえ言っている。

個人情報保護と社会性、公共性の問題はもっともっと議論を重ね、方向性を間違わないようにしないと、本当にギクシャクとした生きにくい社会になってしまう。法律が、現実の社会生活を無視して一人歩きを始めると、恐怖社会に通じる道になることをよくこよく考えて貰いたいと思う。

Last night, I had a drink with my friends for the first time in a long time under the guise of a year-end party. The friend is almost the same age as me. However, he is still in active service, having spent a whole year in the Philippines last year, and has been working hard to move to Nagasaki from this spring.

He came back to the Kansai region for the first time in a long time, taking advantage of his time at work. As a matter of fact, that friend of mine had caused a head-on collision accident with a car about a week ago. According to the story, both cars were a mess, and there was an accident that forced the cars to be scrapped. However, thanks to the airbag and the seatbelt, I felt a slight pain in my chest and the other guy got about 10 stitches on his head from the windshield, but he seemed to be in good spirits and seemed to have no aftereffects, although it was a serious incident.

In the story related to the accident, my friend immediately called the police after the accident, as well as his family. Then, the ambulance and the police immediately rushed to the scene, and the other person (who was bleeding a lot of blood from his head and was in such a state that it seemed like his life was in danger…) was also transported by a different ambulance.

Families who have been contacted are anxious. At the same time, the other person’s life, the condition of the injury…? Naturally, I asked the police. Then, the police officer said, “I can’t answer that. It’s personal information… They want to know what hospital the victim was taken to and what the condition is. When I think about it, I can’t stand still. I think it’s an extremely natural feeling. However, the police officer said that it was a single point of view, “I can’t answer because it is personal information…”.

My pissed off friend: “What’s your personal information…? How can this be? It seems that he was very prodded. Then the policeman said, “Actually, we think this is strange too. But I can’t help it from my point of view…

Come to think of it, there was an incident in Kameoka City where an unlicensed car rammed into a group of schoolchildren and several of them died. In that accident, the parents of the perpetrators wanted to apologize to the victims and asked a police officer.

Since the disciplinary action was taken, it must have been the result of consideration, discussion and debate by a person who is well versed in the law, but there is something wrong with the common man’s sense. It’s not like they don’t match reality, what is the information for and what is the protection of the information for…. It seems to me that this is the result of a “let’s-not-know-what” attitude, in which all the flaws are covered up in light of the text of the law.

In this case, it is understandable that if you are a police officer, you have no choice but to say, “This is personal information… It would be a shame if they were to answer the question, “What is the extent of your injury in any hospital? However, what’s the harm in teaching it… Or is it the right way to think that it is your own choice to worry about the other person, and if you are worried about them, you should worry about them.

At least I don’t want to live in such a society. I don’t want to live in a society where there is no sympathy or sympathy.

If we don’t discuss the issues of privacy and social and public nature more and more, and make sure we don’t go in the wrong direction, we’re going to have a really awkward and hard-to-live society. 毎年の事ながら、この時期になると協会や組合から会報原稿の依頼がある。従って、これも毎年の事ながら、今週のブログは、今日書き上げた会報原稿を添付し、お茶をにごすこととする。

個人情報「過」保護が日本を破壊する

私のデスクの上に、表題の本が置かれている。青柳武彦先生が著した、ソフトバンク新書出版の本である。今はサラッと目を通しただけであるが、読むまでも無いと云った感じ。本の題名の通り、０５年４月に施行された個人情報保護法が原因で、人と人とのコミュニケーションが上手く行かず、ギスギスした社会になってきて、何処かおかしい、どこかが狂っている、と感じる、おかしな社会になりつつ有ることに、強い危機感を持ち、警笛を鳴らせているのである。

一ページめくる毎に、「そうだ、そうだ、その通り」。相槌を打ち、大声で叫びたくなる程に我が意を得た内容である。

先生は、個人情報保護法が施行されるやいなや、この法律の問題点を指摘し、有用性のある個人識別情報と保護されるべきプライバシーに関わる個人情報を、区別することなく十把ひとからげにしている事を指摘し、このままで行けば・・・と、匿名社会の到来を危惧しておられる。

先般、事務局長より電話で、ＮＣＩＡpressの原稿を、と催促された。アッそうか、もうそんな時期か、と思いながら、さて、去年は、一昨年は、と思って、過去のＮＣＩＡpressを引っ張り出し、自分の記事を読んでみた。何となんと何時も同じこと。戸籍住民票問題から個人情報問題など、毎度のボヤキ節で占められている。しかし、今年もまたボヤクのだ！。誰が何と言おうと、おかしいものはおかしい、間違っているものはまちがっている。

住所、氏名、年齢にプライバシーは存在するのか・・？、単なる個人識別情報では・・？。ただ個人識別情報も他の情報と合体させる事により、プライバシー性が強くなる。「よって一概には言えない」と云う。全くその通りであろう・・・。だからあらゆる問題、あらゆるケースを吟味し、公開にすべきは公開に、護らなければならないものはまもる。ただ、適用除外基準をキッチリともうけると同時に、多くの問題を比較衡量し、慎重に検討しなければならないと思う。

行政も企業も団体も、個人情報保護法施行当初よりは、頑なな姿勢は緩んできた様に思う。それでも、「個人情報は一切お答えできません」「それは個人情報ですから・・」と、個人の事に関する質問には一切応じない、と云うところも少なくない。個人情報は一切出さない、個人情報は本人承諾なくしては一切言えない、もし、それが正しいとしたらコミュニティーは成立せず、疑心暗鬼のギクシャクとした匿名社会が構築され、何が本当か何が嘘か判らない、詐欺師天国的社会が構築される事になりはしないか。

探偵業務の大半はプライバシーと個人情報に密接に関係する仕事であり、個人情報を入手せずして仕事は成り立たない。しかもプライバシーに関わる問題が多くある。しかし、プライバシーを調べるからプライバシー侵害とはならない。調べたプライバシーを確り管理せず、漏れたり、漏らしたり、公開したり、すれば侵害につながるおそれはあるが、調べることイコール侵害とはならない。

プライバシーや個人情報が、権利として一定の位置をしめる様になってきた昨今、プライバシーや個人情報を調べることが社会悪であるかの如く云う人がいる。不思議な感覚である。人が人と付き合うとき、会社が人を雇うとき、商売の取引をするとき、等など、あらゆるときに、相手がどんな人か、よく知ってからでないと深くは接触しないのが普通だと思う。その為には、方法は別として、相手をよく知ろうと思うのは当然の事である。ところが、その為に、調査会社が調査をすると色々と問題視される。いったいこの感覚は何なのであろう？。

総じて言えることは、調査会社の社会的認知度の問題が大きく影響しているのではなかろうか。アメリカやイギリスなどは探偵社、調査会社の社会的認知度は極めて高く、それ故に、特別の権限さえ持たされているくらいで、あらゆる場面で調査は非常に重要視され、調査しなかったが為に咎められることはあっても、調査をしたからと云って問題視される事は先ずない。ところが、日本は調査をしたと云うだけで、何か悪い事をしたかのごとく言われ、最近のマスコミ報道をみても調査会社に対する姿勢に非常に冷たいものを感じる。ただ、マスコミが調査するのは当たり前で、調査不足で報道しようものなら、調査不十分と逆に叩かれる。しかし、調査会社が調査すると、調査そのものが違法行為かの如く報じる。マスコミの情報入手の方法や取材こそ、眉をひそめたくなるばかりであるが、自分らは知る権利をバックに何でもＯＫかのごとく振る舞い、調査会社が行うと罪悪視する。そして、それが正論の様に取られるのは、社会的認知度の問題が背景にあるのでは無かろうか・・・。

私達、組合員はこんな問題をもっともっと考え、社会から一定の評価を得られる業界に成長させ、社会的認知度を高めて行かないと、いくら正しい事を云っても、社会はそれを認めてはくれない。ただ、行政に対しては、ハッキリと主張すべきは主張しないととんでも無いことになる。厚生労働省など「調査＝差別」とハンで押したかの如くで、「公正な採用選考をめざして」や「採用と人権」などの広報雑誌などは、目を覆うばかりの調査罪悪論を展開している。「公正な採用選考のためには、調査が必要不可欠である」などの私の主張など歯牙にもかけない。しかし、正直な履歴書と詐称された履歴書の区別もできず、いかにして公正な採用選考が出来るのであろう。また、今の採用調査が如何なるものかも全く調査せず、３０年以上も前の採用調査を題材に差別に繋がる云々と説いている。時代錯誤も甚だしいが、改正しようとする姿勢など全くない。この姿勢には、相当な裏事情があるように思われる・・・。

Protecting “too much” personal information will destroy Japan

On my desk sits the book with the title. This is a book written by Mr. Takehiko Aoyagi and published by Softbank Shinsho. I’ve only skimmed through the book now, but I don’t think I need to read it. But it does not constitute an invasion of privacy because it examines privacy. If you do not manage your privacy properly, and if you leak, divulge, or disclose the information, it may lead to an infringement, but it does not mean that the investigation is an infringement.

In these days when privacy and personal information have come to be placed in a certain position as a right, there are those who argue that examining privacy and personal information is a social evil. It is a strange feeling. When a person is in a relationship with a person, a company hires a person, a business transaction, etc., etc., I think it is normal for people not to have deep contact unless they know what the person is like. For this reason, it is natural to try to get to know the person well, regardless of the method. However, because of this, when an investigation company conducts an investigation, it is considered a problem in various ways. What on earth is this feeling?

All in all, I think that the problem of social recognition of the survey company has a large impact. We, the members of the union, need to think more and more about these issues, and we need to grow the industry to be able to gain a certain level of recognition from society, and to raise its social recognition. However, if you don’t assert what you should clearly assert to the administration, you’ll be in trouble. The Ministry of Health, Labor and Welfare and other public relations magazines such as “Aiming for Fair Recruitment Selection” and “Recruitment and Human Rights” have made an eye-popping case for investigations. They don’t give a damn about my assertions, such as “an investigation is essential for fair recruitment and selection. But how can a fair selection be made without being able to distinguish between an honest resume and a spoofed resume? 今朝、女房と二人で久しぶり（しばらく隠岐に帰っていた為）に食卓を囲んだ。で、女房曰く、「お父さん最近ブログ書いてないね・・・何か話題見つかった？」 「何もない、なんかないかな？」、と応じるが早いか、あの話は？、この話は？・・・出るはでるは、次からつぎ ポン・ポン・ポン ・・・・。小生、ご飯を食べながら、うん、ウン、うん、と生返事・・・（何となく情景が思い浮かぶでしょう・・・・・）。何処の家庭でも、だいたいそんなものでは・・・。

そういえば、以前こんな事があった。

ある日の事、食卓を囲んで、女房がその日の出来事を事細かく話し出す、小生、適当に相槌をうちながら黙々と食事・・・、何も変わらぬ何時もの風景である・・・。ところが、その日にがぎって、女房が突然、「ねー、お父さんどう思う？」と質問を投げてきた。ウン・・・、「ねー、お父さんどう思う？・・・」、再度問いかける・・・しまった・・、適当に相槌はうっていたものの、その実、話は全く聞いてなく、他ごとを考えていたのだ・・・。

「何が・・・・」、「何がじゃ無いでしょう・・・私が大事な話ししているのに、あなた何も聞いてなかったんでしょう、 ほんとにモー・・・」 怒り心頭である。

小生曰く、「こんな時は質問するもんではない・・・」、 以後数日沈黙の日々、アットホームであったはずの我が家が、しばし針の筵であった。トホホ・・・・。

以後、たまにそうした事はあるにしても、出来るだけ話は聞くよう心掛けている。 世の亭主諸君・・ここが肝心なところですぞ。

今朝も適当に聞いてはいたものの、実はその中で面白い話がひとつあった。

それが、「お得な故郷納税」の話、 故郷納税をした人への各市町村のお返しが凄く凝っていて、しかも故郷納税の実質自己負担金（故郷納税は、寄付金控除の対象であり、故郷納税額を確定申告すると、その額が税金控除になる。通常、住民税の１０％を自分が好きな市町村に納税し、その額を確定申告すると、それが控除されるため、納税者は実質的には数千円程度の負担にしかならない）より多額の商品が送られてきて、結果的に故郷納税した人が実利を得ることになるらしい。

岐阜県の某行政など、何のお返しもしなかった時は５人に満たない故郷納税であったらしいが、地場特産の豪華商品をお返しにするや、一挙に故郷納税額が１０倍にもなったとか。従って、地場の商品目当てに縁も所縁もない人が、故郷納税をするケースも多くなっているとのこと。

極めて打算的で細かく、純粋な故郷納税の趣旨には合わないかも知れないが、少なくとも喜ばれこそすれ嫌がられる事はない。三方良し、とまではいかなくとも、二方良し、は間違いなし。

2008年にスタートしたころに比べて最近は話題になることが少ない「ふるさと納税」が、実は大変お得なことになっているらしい。各自治体が獲得競争に力を入れ、寄付してくれた人に地元の特産品などどっさり送ってくれるのだ。寄付は所得税や地方税に控除対象となるから、ほとんど負担はなく各地の美味しいものを楽しむことができる。

カニ、ステーキ肉、お米、お酒、宿泊券…

ふるさと納税をするとどんなものが送られてくるかというと―。肉、魚介、野菜、米、加工食品、酒、米、くだものなどの食料品はもちろん、アクセサリーや化粧品、地元イベントや観光地のチケットや宿泊券など、まあ、なんでもあって、しかも好きなものをチョイスすることができる。たとえば、1万?3万円を鳥取県に寄付をすると松葉ガニの大きいのが1杯、宮崎県ならステーキ肉2枚、北海道むかわ市なら無添加ソーセージ、佐賀県なら真鯛…といったものが選べるのだ。地方自治体が，全体の半分以上になっているからだ。

都内に住む按田さんはこの制度を利用して、今年も10自治体に寄付をした。冷蔵庫の中は地方から贈られてきた特産品がいっぱい。「これは静岡の磐田市から贈られてきたウナギのかば焼きの冷凍品。こっちは北海道浦幌町からのジンギスカンとソーセージの詰め合わせ、岡山の津山市からはたこ焼き器をいただきました。地元にメーカーがあるそうなんです。

ある市長さんからはお礼の手紙もいただきました。税金を払ってお礼を言われたことなかったので、感激しました」

マーこんな調子である。しかも、故郷納税額は控除対象なのだから、少し面倒だが確定申告さえすれば、その納税額は還付され、しかも、郷土の特産品が感謝の言葉と共にゲットできるのである。

人の恋路を邪魔する奴は、馬に蹴られて・・・等と云う言葉があった様に思うが、どうも、そんな事も言っておれない時代になっているようだ。

昨日の新聞報道によると、昨年１１月に起きた「逗子ストーカー殺人事件」の裏に調査会社が関係していたらしい。「住所、調査会社が売却か」と、３面トップに特大の見出しが載っていた。記事を読むと、殺人犯が調査会社に被害者の住所割り出しを依頼し、調査会社は、その調べを情報屋と呼ばれる業者に頼み、結果、彼女の住所が判明したことから、逗子ストーカー殺人事件に繋がったと見られている様である。

この記事を斜め読みすると、調査会社って何と云う所だ。金にさえなれば何でもやるのか。個人情報が漏れると、殺人などと云うとんでもない事に繋がってしまう。個人情報を取るなどけしからん・・・・。

そんな声があちこちから聞こえそう・・・、また、マスコミもそういう姿勢で報道している様である。

探偵社は、法律（探偵業法）によって、調査契約の際、依頼者から、調査結果を犯罪や差別に使わない旨の誓約書を取らなければならない事になっており、もし、依頼時点で「どうもおかしい・・・」と感じたら、誓約書はあっても仕事をお断りするようにしているのが、普通の調査会社である。

ところが、「おかしい？」、と見抜くのは中々難しい。今回のケースでも、殺人に使うから住所を調てほしい等というはずもなく、結果的にはこんな悲惨な事件に結び付いたが、あくまでそれは結果論であり、調査会社は決して事件に加担する意思を持っていた訳ではない。

飛躍と言われるかも知れないが、これは、包丁が殺人に使われたすると、その殺人に使われた包丁を売った商店を、殺人に協力したとして、悪徳商店にするのと同様である。

調査会社に住所を調べて欲しい・・・と云う依頼は日常茶飯事にある。住所が判った結果、トラブルが未然に防げた、詐欺被害を逃れることができた、感情のもつれをほぐす事ができた、自殺を思い留めさせる事ができた、財産保全ができた・・・,会って感謝の意を伝えることができた・・、等など事例を上げればきりがない。それだけに、お客の喜ぶ声が聞きたくて、この仕事を続けていると云う業者も多くいる。しかし、こうした、感謝されるような調査は表に出ることは先ずない。ただ、今回のような事件は大々的に報道され、他人の住所を調べるなんてとんでもない、と受け取られ、調査会社≒ワル、悪徳、とのレッテルを張られる結果となる。トホホ・・・・
