今週は、週初めから何かとバタバタして、ゆっくりパソコンに向かう時間も無かった。そんなこんなでブログも更新できず、今日も殆ど時間が取れない。そこで何時もの奥の手、引き出しを開くと、愛調協さんに提出したほやほやの原稿が出てきた。これを使わない手は無い・・・。

愛知県調査業協会員の皆様、今日は・・。私は関調協の会長を仰せつかっている松谷と申します。愛調協さんの会報誌に投稿の機会を頂きましたこと、有り難く、厚く御礼申し上げます。
大阪の現況ですが、公安委員会への届出は５００社を少し超えるまでになっている様です。しかし、実際に探偵業を専業として営んでいる所は１００社に満たない様に思います。大阪府下では１０数年前のピーク時で２００社余、今は１００社を切るのではないかと推測しています。
所謂半減です。原因は何なのか？私なりに分析してみますに、第一は、失われた２０年と云われる経済不況でしょう。第二は、人権やプライバシー意識の高まりと、それに伴う行政指導及び団体運動による影響。第３は、業者自らの姿勢によるものではないでしょうか。
第一の経済不況は、私たちの力ではいた仕方ありません。しかし、第２・第３の問題は、業界団体として対処して行かなければならない重大な懸案と考えています。
２１世紀は「人権の世紀」などと云われ、人権に対する意識は非常に高まりつつあります。しかし、人権に対する考え方は、国、地域、人により様々で、必ずしも一定したものではありません。ただ、人権の名宛人は、国などの公権力になる場合が大半で、私人間では可なり違って来ます。ところが、人権意識の高まりにつれ、この事を履き違え、国、社会、団体、企業、個人、夫々の立場で人権の保障範囲は違うにも関わらず、名宛人なしで人権を主張する、首を傾げたくなるような現象が多く見受けられるように成ってきました。日本国憲法では、人権に関し「濫用してはならず、常に公共の福祉のためにこれを利用する責任を負う」と規定されています。ところが、最近「人権のインフレ化」などと云う言葉が囁かれるように、人権を錦の御旗に権利だけを拡大解釈して主張し、義務を蔑ろにする傾向が非常に強くなっている様に思います。
個人情報保護法の解釈などにはその傾向が顕著に見受けられます。この法律は、データベース上の個人情報を管理する法律であり、個人情報取り扱い業者（５千件以上の個人情報を体系化し、事業に供する者）がその対象であるにも関わらず、個人情報の取扱いには全て本人承諾を要す、と解釈され、個人情報の有用性に対する配慮など全く眼中に置かず、無条件に個人情報を保護しているかの如く、都合が悪い事は全て、個人情報保護を盾に、逃げ隠れする現象が顕著になってきています。
住民票や戸籍に関しても、人権やプライバシーに対する考え方の中で、今の取り扱いになっているのでしょうが、真に平穏な安寧な公平な社会を望むのであれば、もっともっと議論を深めなければならないと思います。こんな事は行政官が一番肌で感じているはずなのですが、如何なる力が働いてのことなのか・・・。
少なくとも、履歴書など本人の申告事項が正しいか否かくらいは確認できる社会システムにしておかなければ、「正直者がバカを見る」おかしな世の中になって仕舞うのは明らかです。
調査と云う仕事は、人類が共生生活を営むようになって以来、自然発生的に生まれたものであり、安全で公平な社会を維持するには必要不可欠なもので有ります。
その事に注力し、自らの仕事に誇りを持ち、業界人皆が団結し、調査の正当性を堂々と主張し、社会的認知を得て、正しく正確な調査ができる社会システムを標榜し、業界人皆が一緒になって活動して行かなければ、今の業界不況から抜け出すことは難しい様に思われます。
愛調協の皆様、共に力を合わせ、業界発展の為に活動する真の協会を作るため努力しようではありませんか・・・。

Dear Aichi Prefecture Surveyors Association members, today… My name is Matsutani and I have been asked to be the president of the Seki-Coop. I would like to express my deepest gratitude for the opportunity to contribute to the bulletin of the Aichou Kyou.
As for the current situation in Osaka, the number of companies reporting to the Public Safety Commission is a little over 500. However, I think there are less than 100 companies that are actually engaged in the detective business as a full-time business. It is estimated that the number of companies in Osaka Prefecture peaked at more than 200 a dozen years ago and is now below 100.
So to speak, it’s reduced by half. What is the cause? In my opinion, the first is the lost 20 years of economic recession. The second is the rise in awareness of human rights and privacy, and the resulting impact of administrative guidance and group movements. Thirdly, I think it depends on the attitude of the vendors themselves.
The first economic recession was unavoidable on our own. However, I believe that the second and third issues are serious concerns that we have to deal with as an industry association.
The 21st century has been called the “Century of Human Rights” and awareness of human rights is increasing dramatically. However, attitudes toward human rights vary from country to country, region to region, and person to person, and are not always constant. However, in most cases, the person to whom human rights are addressed becomes a public authority such as the state, and it is quite different for a private person. However, as awareness of human rights has increased, there have been many phenomena that I want to tilt my head, which misunderstand this and assert human rights without an addressee, even though the scope of guarantee of human rights is different in the country, society, organization, company, individual, and each person’s position. The Constitution of Japan stipulates that human rights “shall not be abused and shall always be responsible for the use of them for the public welfare”. However, recently, as the term “inflation of human rights” has been whispered, I think that the tendency to use human rights as a banner to expand the interpretation of rights and disregard obligations has become very strong.
This trend is evident in the interpretation of the Personal Information Protection Act. In spite of the fact that this law is a law to manage personal information in the database and is applied to personal information handling companies (those who systematize more than 5,000 pieces of personal information and provide them to the business), it is interpreted that all handling of personal information requires the consent of the person concerned, and there is no consideration for the usefulness of personal information, and the phenomenon of running and hiding, using the protection of personal information as a shield for all inconvenient matters, is becoming prominent.
I think that if we want a truly peaceful, well-being, and fair society, we need to deepen the discussion more and more. This is something that government officials must be feeling firsthand, but I don’t know what kind of power is at work…
If we don’t have a social system that allows us to at least check whether or not the information on a person’s resume is correct, it is clear that we will end up in a strange world where “honest people look at fools”.
Since human beings have been living together, research work has been a spontaneous occurrence, and it is indispensable for maintaining a safe and fair society.
If we don’t focus on this, take pride in our work, unite with all members of the industry, boldly assert the legitimacy of our investigations, gain social recognition, and advocate a social system that allows us to conduct accurate and correct investigations, and work together with all members of the industry, it will be difficult to get out of the current industry recession.
Let’s make an effort to make a true association to work together for the development of the industry.
